Allocation of Unidentified Support Payments

  1. OVERVIEW

The purpose of this policy is to provide staff and members of the public a working knowledge of the allocation of unidentified support payments, not made by income withholding, from obligors with multiple cases. When the payments are not identified as to case or obligee, the DCSS staff proportionately allocates the payments between the cases. The unidentified payments include, but are not limited to, administrative asset seizures from financial institution accounts, payments for release from custody, or lump sum payments from the obligor.

  1. APPLICABILITY

This policy applies to all Arizona IV-D program staff performing Title IV-D services.

  1. POLICY

DCSS shall use procedures established by Arizona Administrative Code to proportionately allocate payments that meet specific criteria.

  1. CRITERIA
  1. DCSS receives a support payment, not paid by an income withholding order from an obligor that is unidentified as to case or obligee.
  2. The support payment does not satisfy the total current support owed by an obligor to multiple obligees.
  3. The support payment does not satisfy the total arrearages or past support owed by an obligor to multiple obligees.
  4. The support owed to the obligee was submitted for the enforcement action that resulted in the collection.

If all criteria are not met, the procedures, supported by this policy are not required to allocate the payment.

This policy is supported by staff procedures, which identify how action related to this policy will be conducted, including responsibilities, time frames, and required actions.
